Terms of Service

Welcome to PassLPN Pro. These Terms of Service (“Terms”) govern your access to and use of the PassLPN Pro website and study application (the “Service”), operated by PassLPN Pro (“we”, “us”, “our”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.

1. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this requirement and that the information you provide is accurate.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@passlpnpro.com if you suspect unauthorized access. You may not share your account with others or transfer it without our permission.

3. Subscriptions, billing, and refunds

The Service offers a free tier and paid plans. Paid plans are billed in advance through our payment processor, Stripe. Prices, features, and free-tier limits are described on our pricing page and may change with reasonable notice.

  • Monthly plans renew automatically each month until canceled.
  • Time-limited bundles (for example, 3-month plans) are one-time purchases that grant access for the stated period and do not auto-renew.
  • Cancellation: you can cancel an auto-renewing subscription at any time from your account page; cancellation takes effect at the end of the current billing period.
  • Refunds: if you are unsatisfied, contact us within 7 days of your initial purchase for a full refund. After this period, payments are non-refundable except where required by law.
  • Failed payments: if a renewal payment fails, your access may be downgraded to the free tier until payment is restored.

4. Acceptable use

You agree not to:

  • Use the Service in violation of any law or regulation;
  • Resell, redistribute, scrape, or republish content from the Service;
  • Attempt to bypass usage limits, paywalls, or other access controls;
  • Reverse engineer, decompile, or otherwise attempt to extract the source code of the Service;
  • Use automated systems (bots, scrapers, scripts) to access the Service or the AI Tutor without our written permission;
  • Submit content to the AI Tutor that is unlawful, harmful, or that infringes another person’s rights;
  • Interfere with the Service’s operation or security.

We may suspend or terminate accounts that violate these terms or that abuse the Service or the AI Tutor.

5. AI Tutor

The AI Tutor uses third-party large language models to generate responses. Responses may be inaccurate, incomplete, or out of date. The AI Tutor is a study aid, not medical advice or a substitute for instruction from a licensed nursing educator or clinician. Always verify clinically relevant information with authoritative sources before applying it in practice.

6. Educational disclaimer

PassLPN Pro is an independent study platform. We are not affiliated with, endorsed by, or sponsored by the National Council of State Boards of Nursing (NCSBN), and our use of the term “NCLEX-PN” is for descriptive reference only. NCLEX® and NCLEX-PN® are registered trademarks of NCSBN. We do not guarantee that using the Service will result in passing the NCLEX-PN or any other examination.

Content accuracy. Our lessons, quiz and practice questions, HESI-style items, flashcards, lab-value references, and other study materials (the “Study Content”) — including the suggested correct answers and rationales — are prepared with care but are provided for educational purposes only. Although rare, the Study Content may contain errors, omissions, or information that becomes outdated as clinical guidelines evolve. You should not rely solely on the Study Content; always cross-reference clinically relevant information with your course materials, nursing faculty, current clinical guidelines, or other authoritative sources before applying it in practice or on an examination. The Study Content is not medical, clinical, or professional advice.

7. Intellectual property

The Service, including all lessons, questions, flashcards, illustrations, code, and design, is owned by PassLPN Pro or its licensors and is protected by copyright and other intellectual-property laws. We grant you a limited, personal, non-transferable, non-exclusive license to use the Service for your own non-commercial study. All other rights are reserved.

8. User content

You retain ownership of any content you submit (for example, AI Tutor questions). By submitting content, you grant us a worldwide, royalty-free license to host, store, and process that content as needed to operate and improve the Service.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if your account is inactive for an extended period, or if we discontinue the Service. Sections that by their nature should survive termination will do so.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY CONTENT IS ACCURATE OR RELIABLE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PASSLPN PRO AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US$50.

12. Indemnification

You agree to indemnify and hold harmless PassLPN Pro and its officers, employees, and contractors from any claim or demand arising out of your violation of these Terms or your misuse of the Service.

13. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.

14. Changes to these Terms

We may update these Terms from time to time. We will post the new effective date at the top of this page and, for material changes, provide notice through the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
